Acceptance of our terms and conditions

(1) By purchasing services and/or products on this site, you are accepting the terms and conditions set out below. Please read these terms and conditions carefully and make sure you understand them before booking any Gutsy events or services.

(2) The following terms and conditions apply to all persons, companies and or other entities (i.e. “you”) that are participating in “events” or services organised by “us”. The term “event” includes all our services i.e. programmes, courses, workshops, introductory and taster events, individual/1-to-1 sessions and other events and services offered by “us”. The terms “we” and “us” includes Susannah Worth, the founder of Gutsy.

(3) If you are not willing to be bound by these terms and conditions, please do not purchase services or products from this site.

Changes to terms and conditions

(1) We reserve the right, at our discretion, to modify, add to or remove any or all of these terms and conditions at any time and each such change shall be effective immediately upon posting.

(2) Please check these terms and conditions periodically for changes.

(3) Your continued use of this site and purchase of services or products on this site following the posting of changes to these terms and conditions will mean you accept those changes. Please check the terms before every purchase.

(4) If the revised terms apply to any existing provision of services, we will notify you of the changes.

(5) These terms and conditions shall continue until the end of the Gutsy event or service you have purchased or booked, when this contract shall expire other than for the Terms that are specifically stated to remain in force.

PURCHASE & BOOKING POLICY

(1) You can book directly online to secure your booking. Some events have a limited number of places.

(2) The fee for attending the event will be stated on the relevant webpage. Please read the information on the online booking page and be sure you understand it fully and that you are aware of our cancellation and refund policy. We reserve the right to sometimes run price promotions, free places or discounted places.

(3) If you are paying for yourself, there may be an option to pay by instalments. Further information will be stated on the online booking page. The deposit is in all cases non-refundable.

(4) If your employer is paying for you, you/they will be required to pay in full. If your employer requires an invoice, please notify us and include any details we need to know for the invoice, by emailing hello@sogutsy.co.

(5) With the exception of agreed and arranged instalments, all payments must be made in full prior to the start of the event.

(6) Payment will be made via Stripe and you consent to us passing your necessary details to the provider and to them processing necessary information about you.

(7) On booking, we also require you to fill in a booking form with your contact details. We may also require you to complete a more in-depth intake form to ensure we are aware of your reasons for participating, any needs you might have in order to participate fully and comfortably, and any other conditions of which we should be aware, as relevant to your participation in the course. You will also be required to accept our terms and conditions and be made aware of our data protection and privacy policy as part of the booking process.

Payment by instalments

(1) If you are paying for yourself, it is possible to pay for our courses by instalments via Stripe. Please see booking details for the event you want to book.

(2) Please be aware that you commit to paying for all the sessions, even if you decide or have to leave the course and even if you are paying in instalments. Please honour the arrangement you have made so we can continue to offer this option to others.

(3) If you encounter financial difficulties, please be in touch with us so we can find a way for you to continue with the course, for example through a long-term instalment arrangement.

(4) If an instalment payment fails, we will inform you and give you an opportunity to make the payment again.

Cancellations and refunds

(1) In the event of cancellation by you after paying in full, a refund of the balance (less the non-refundable deposit and less any Stripe fees or credit card fees) will be made provided that 14 days’ notice is given before the course begins. If we are able to fill your place, we may be able to transfer the full fee you have paid to a future course. This is at our discretion.

(2) No refund will be made if, for whatever reason, you cancel less than 14 days ahead of the date your course starts or after the course has begun.

(3) If you cancel a debit/credit card or electronic payment without contacting and consulting with us first, you will not be able to participate in any future courses until the amount owed is paid in full. You will have accepted these terms and conditions when you booked and so you are legally bound to make payment. If your situation has changed and you are struggling to pay, please contact us at hello@sogutsy.co so we can discuss your situation. We will do what we can to support you.

(4) In the unlikely event that we have to cancel your course, a full refund will be made less any Stripe fees or credit card charges. We do not cover any travel costs or related costs incurred.

(5) In case of future lockdowns due to Covid-19 or any similar public health emergency, when we are unable to run courses safely in person, we will move the course online.

(6) If, after the first session, you feel that the course is not suitable for you, then get in touch with us. We may suggest doing some individual/1-to-1 sessions or participating in some other kinds of work before rejoining the course at a future date. We may approach you if we feel that the course is not suitable for you or if we believe you would benefit from some extra help.

(7) Our sole liability in relation to any cancellation, postponement or change of venue shall be limited to the price paid by you for the event and we shall not be liable under any circumstances for any consequential losses.

Low numbers on courses

(1) We may elect to run a course with low numbers rather than cancel it, for the benefit of the participants who have booked. If we choose to run the course and so long as the course material is covered, we reserve the right to reduce the total number of sessions.

(2) If we choose to reduce the total number of sessions, we will inform you in writing.

Travel and accommodation

(1) You will be responsible for making and paying for your own travel and accommodation arrangements to and from the event.

(2) If you arrive late to the event or are prevented from attending due to travel delays or any other circumstances, we shall not be obliged to provide you with a refund or to delay starting the event until you arrive.

Age restriction

(1) Our events are designed for people aged 18 and over.

(2) If you are under 18 years old, you are not permitted to purchase any services or products from our site because you do not have legal capacity to enter into a contract.

(3) If you are under 18 years old and are interested in attending an event, please contact us at hello@sogutsy.co and we can arrange a conversation to ensure the course is suitable for you. The conversation can include your parent or guardian. We will need your parent or guardian to give permission for you to attend the course and book on your behalf.

(4) You might decide that an individual/1-to-1 session is more appropriate than a group workshop or course. Your parent or guardian must book and make the payment for you.

CODE OF CONDUCT

Your obligations

(1) Gutsy asks you to open your mind to new possibilities while you are participating in one of our events.

(2) While you are participating in our events, we ask that you develop the practice of taking full responsibility for yourself and your learning and for getting any additional support you may need. Taking responsibility for yourself builds confidence.

(3) Please inform us in advance about any medical, mental or emotional conditions, either past or present, which may affect your health or suitability to participate in the event. This information will be confidential. If you are currently in therapy, we recommend that you discuss doing the course with your therapist.

(4) If you are verbally antagonistic, persistently resistant and your conduct is having a negative impact on other participants, we reserve the right to ask you to leave the course or workshop and we shall not be liable to refund your payment.

(4) Please keep your personal belongings with you at all times as we accept no liability for any damage, loss or theft of any of your belongings or other items brought to the event by you.

Our obligations

(1) Through your participation, we offer you our heartfelt support to assist you in overcoming your issues. If you have any problems, please communicate with us so we can support you better.

(2) If for any reason, we feel that the course is not right for you, it may be possible to transfer you to another course, book you into a future course or enrol you in some individual/1-to-1 sessions, either in addition to your course or in place of it.

(3) If we observe that the course that you are booked onto is having a detrimental effect on you and we are not able to offer the help you need, we will refund your course fees for the remaining sessions, less any Stripe fees or credit card fees.

(4) We warrant you that Gutsy and any products purchased from us are of a satisfactory quality and reasonably fit for the purpose for which Gutsy events are supplied.

(5) We will endeavour to ensure that all information that we provide is accurate and up-to-date but we shall not be liable for any claims arising from such information being inaccurate or not up-to-date or otherwise.

(6) We are responsible only for providing Gutsy events. We do not guarantee any particular result.

(7) Optional support services will be available in the form of follow-on courses or individual/1-to-1 sessions to assist you in overcoming these issues. These services will carry a separate fee.

Commitment

(1) Please note that commitment to Gutsy events and services is important in order for it to be effective for you and, if a group experience, for the other participants.

(2) Attend even when you are feeling vulnerable and uncertain. Come as you are. Gutsy events are all about change and manageable challenge, and so are likely to activate your defence mechanisms and resistance. We will support you through your challenges so you can move through what’s kept you stuck in the past.

(3) People who are committed and willing to give attention and energy to our events often achieve the best results. Making a commitment to show up for yourself is often a powerful step to making a real difference to your confidence.

(5) You are not obligated to attend every session in our longer courses (those that run longer than 4 weekly sessions). The progress you make will not be significantly affected. However, we encourage you to prioritise yourself and your commitment to change, whenever possible.

(6) All missed sessions must be paid for. If you miss too many sessions, particularly key early sessions in a course, we may suggest that you repeat the course. You will be offered a discount to repeat the course.

Eligibility and Accessibility of the Service

(1) Our events and services are aimed at being supportive and transformative for those who are ready for change.

(2) We are unable to help with acute or suicidal crises; if a client is suicidal they should be encouraged to contact the emergency services. They may also contact www.samaritans.org or telephone them on 116 123 (UK).

(3) You will be required to complete an intake form when you book for our events and services. Based on the information you provide, if we have to decline use of our service, we will try and suggest alternative support. We aim to be conscious of everybody’s wellbeing and its importance and that everyone should have the opportunity to seek the best support for their specific needs.

(4) Our events and services are designed for adults 18 years and over. Please also see ‘Age Restriction’ under ‘Purchase & Booking Policy’. Young people looking for support may be better supported by calling Childline on 0800 1111 or visiting their website at www.childline.org.uk.

Confidentiality

(1) Your confidentiality is assured when participating in any Gutsy events or services. We request confidentiality from all participants so that everyone can feel safe and that whatever they share will not be repeated or discussed by other people outside the group.

(3) Susannah Worth is in regular supervision and will discuss certain anonymised cases and experiences in this confidential setting. These sessions are held with a qualified dramatherapist who is a member of the Health and Care Professions Council (HCPC) and the British Association of Dramatherapists in the UK and abides by their code of ethics. Sessions are never recorded.

Privacy

(1) We acknowledge that in the course of delivering Gutsy events and services we will have access to your confidential information. We agree not to (except in the proper course of our duties) use or disclose to any third party such confidential information. Please see our Data Protection and Privacy Notice.

(2) When you sign up for an event or service, you acknowledge that you are aware of our privacy notice. Your privacy and confidentiality are important to us.

Code of Ethics

We commit to:

  • Upholding appropriate boundaries

  • Ensuring open lines of communication

  • Being polite and considerate

  • Listening attentively and taking into account any feedback given

  • Provide information when requested promptly and clearly

  • Practicing only in the areas in which we have appropriate knowledge, skills and experience

  • Pursuing ongoing professional development as necessary

  • Staying up to date with new laws and regulations

  • Respecting confidentiality

  • Upholding professional boundaries and behaving honestly and without judgement

  • We follow the HCPC Standards of conduct, performance and ethics

Compliments, Comments and Complaints

(1) In the event that there is any problem with a Gutsy event or service, please email hello@sogutsy.co as soon as possible or discuss your concern with us in person. We value your feedback and appreciate you giving us a reasonable opportunity to repair or fix any defect. We will make every effort to repair or fix the defect.

(2) You have legal rights in relation to services not carried out by us with reasonable skill and care. After following the steps above, giving us a reasonable opportunity to fix the defect, you must inform us at any time from the date of commencement of the Gutsy event or service, and clearly state how the event or service was not carried out with reasonable skill and care. If we agree that the event or service was not carried out by us with reasonable skill and care (rather than as a result of your action or inaction), we may provide you with a refund of the amount paid by you (minus any non-refunded Stripe or credit card fees) or may make a partial refund. This is at our discretion.

(3) We will consider in good faith complaints made to us in writing, as described above. In the unlikely event that we are unable to resolve any issues and it becomes necessary to refer the problem to a single mediator or into arbitration, we will share the costs of this between us.

(4) We value your comments and compliments too. All your feedback, formal and informal, helps us ensure a continued high standard of practice and service that supports our clients, encourages them to return to us, or recommend our events and services to others.

(5) Feedback will often be gathered formally via online forms sent to you at the end of an event or service. We would be very grateful if you complete these in a timely manner. While very useful to us, they are also often valuable tools for your own reflective practice as part of your processing of what you have experienced and learned.

COPYRIGHT & INTELLECTUAL PROPERTY

(1) Susannah Worth is the owner or the licensee of all Intellectual Property Rights and all other rights in Gutsy events and services and all content within Gutsy events and services and nothing in these Terms or otherwise shall operate to transfer the ownership of the Intellectual Property Rights in the programme or the content of the programme to you or to any other person.

(2) The content and materials in Gutsy events and services are for your sole use only. You may not at any time copy, reproduce, publish in any form, share, sell or otherwise make available to a third party in any way any of the content or materials contained in the programme.

(3) Do not attempt to try out the exercises or processes on others without proper training. Susannah Worth and Gutsy are not responsible for any adverse effects resulting as a consequence of your actions.

(4) Susannah Worth grants to you a limited, non-exclusive, non-transferable, non-sub-licensable, revocable licence to use all or any of the content of Gutsy events and services for the purposes for which Gutsy events and services were provided only.

(5) You may not use any of our intellectual property at any time.

(6) You may not make any audio or visual recordings of any part of our services.

(7) We may on occasion record Gutsy events and services being delivered during your attendance for the benefit of training. We may also record Gutsy events held on Zoom for the benefit of participants who are absent. You will usually be asked for your consent if you are present. You authorise us to use your image and voice in any such recordings, including for our own promotional purposes, without payment, other condition or need for further consent.

(8) You acknowledge that certain information contained in Gutsy events, services and written materials is already in the public domain.

(9) You are not permitted to sell or promote products or services to other participants in Gutsy events without our prior written permission.

(10) All website design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software and all other material on this website are copyright Susannah Worth.

(11) All rights reserved. Any use of materials on this website – including reproduction, modification, distribution or republication – without the prior written permission of Susannah Worth is strictly prohibited.
